{"id":2200,"date":"2020-04-02T10:00:53","date_gmt":"2020-04-02T08:00:53","guid":{"rendered":"https:\/\/www.alting.com\/exceptional-housing-measures-covid19\/"},"modified":"2026-01-23T14:52:43","modified_gmt":"2026-01-23T13:52:43","slug":"exceptional-housing-measures-covid19","status":"publish","type":"post","link":"https:\/\/www.alting.com\/en\/exceptional-housing-measures-covid19\/","title":{"rendered":"Exceptional housing measures because of COVID-19"},"content":{"rendered":"<p>Barcelona, April 2 2020.- This Tuesday, March 31, the government approved a new assistance package for vulnerable individuals aimed at alleviating the <strong>economic, social and health crisis<\/strong> unleashed by COVID-19.<\/p>\n<p>The many measures in Royal Decree-Law 11\/2020, dated March 31, 2020, include <strong>several targeted at housing<\/strong>.<\/p>\n<h3>RENTAL HOMES<\/h3>\n<p>With this new measure, tenants who have been left vulnerable by the coronavirus crisis and can document it may request more flexible measures in <strong>rent payments of their primary residence<\/strong> from their landlords for the month after the Decree is approved.<\/p>\n<p><strong>If the landlord owns 10 properties or fewer<\/strong>, the tenant and landlord can reach their own agreement on rent. If no agreement is reached, the tenant may request interest-free loans or assistance from the State.<\/p>\n<p><strong>Landlords who own more than 10 properties may choose between two options:<\/strong><\/p>\n<ul>\n<li>Allow a <strong>moratorium on the base rental payments as long as the state of alarm lasts<\/strong>, which may be extended month by month up to a maximum of 4 months. This amount must be paid back within at most 3 years as long as the contract does not end before them.<\/li>\n<li>Or a <strong>50% reduction in rent<\/strong> as long as the <strong>state of alarm<\/strong> lasts, with a maximum of 4 months.<\/li>\n<\/ul>\n<p><strong>Tenants who own their own property<\/strong> and\/or have reached <strong>a previous agreement<\/strong> with the landlord may not benefit from these measures.<\/p>\n<p>Only if the landlord (with fewer than 10 properties) <strong>denies the tenant a moratorium<\/strong> that the tenant has requested may the tenant request the assistance provided for in Article 10 of the Royal Decree-Law from the government (loans from the Official Credit Institute payable in 6 + 4 years).<\/p>\n<p><strong>Which tenants may request moratoriums or apply for loans or assistance from the State?<\/strong><\/p>\n<p>In order to benefit from any of these measures, the tenant must prove to the Landlord that they are in a situation of vulnerability.<\/p>\n<ul>\n<li><strong>Unemployed<\/strong> persons.<\/li>\n<li>Workers who have been temporarily laid off as part of a temporary redundancy plan (<strong>ERTE<\/strong>).<\/li>\n<li>Workers who have had to reduce their workday to provide <strong>care<\/strong>.<\/li>\n<li><strong>Business<\/strong> owners who have experienced \u201ca substantial loss in income&#8221; which means that the household in which they live cannot afford the rent payment.<\/li>\n<\/ul>\n<p>It is worth noting that the vulnerability must have been <strong>caused by the COVID-19 outbreak<\/strong>, so only those persons whose <strong>income drop is related to the pandemic are included.<\/strong> The moratorium cannot be automatically requested when the person is affected by a temporary redundancy plan, unemployment, etc., but instead only when <strong>their net income actually drops compared to the month immediately prior to the request.<\/strong><\/p>\n<p>Likewise, the new Decree states that tenants whose r<strong>ental contract ends between 1 April and 2 months<\/strong> after the state of alarm is lifted may have access to an<strong> automatic 6-month extension of all rental contracts.<\/strong><\/p>\n<p>Finally, evictions are also <strong>suspended for 6 months<\/strong> as long as the tenant can <strong>prove to the Court<\/strong> that they are economically vulnerable.<\/p>\n<h3>HOMES FOR SALE<\/h3>\n<p>The measures approved in the <a href=\"https:\/\/www.boe.es\/buscar\/doc.php?id=BOE-A-2020-3824\">Royal Decree from March 17 of this year<\/a> are still in effect; they include<strong> a moratorium in mortgage payments for primary residences for individuals in a situation of economic vulnerability as a consequence of the healthcare emergency caused by COVID-19.<\/strong><\/p>\n<p>The new law allows mortgage holders to stop making these payments and <strong>to repay it in future installments<\/strong> in order to avoid losing their homes.<\/p>\n<p>Likewise, this measure also <strong>benefits banks<\/strong> since it helps them curb defaults at an extraordinary time like now.<\/p>\n<h3>MORTGAGES ON COMMERCIAL SPACES AND OFFICES<\/h3>\n<p>This new Decree <strong>extends the mortgage moratorium<\/strong> announced two weeks ago for <strong>freelancers<\/strong> and <strong>businesspeople<\/strong> who are having difficulties making the payments for their <strong>offices<\/strong> or <strong>commercial spaces.<\/strong><\/p>\n<p>This is similar to the way mortgages associated with primary residences may <strong>delay capital and interest payments<\/strong> and repay them in installments in the future.<\/p>\n<p><strong>All the information on Royal Decree-Law 11\/2020, dated March 31, 2020<\/strong>, enacting urgent additional social and economic measures to deal with COVID-19, are available for consultation in the <a href=\"https:\/\/www.boe.es\/boe\/dias\/2020\/04\/01\/pdfs\/BOE-A-2020-4208.pdf\">Official State Gazette (BOE) published on April 1<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Barcelona, April 2 2020.- This Tuesday, March 31, the government approved a new assistance package for vulnerable individuals aimed at [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":333,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"inline_featured_image":false,"footnotes":""},"categories":[321],"tags":[357,358,354,360],"class_list":["post-2200","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-current-events-en","tag-covid-19-en","tag-homes-en","tag-offices-en","tag-retail-en"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v25.3.1 - https:\/\/yoast.com\/wordpress\/plugins\/seo\/ -->\n<title>Exceptional housing measures because of COVID-19<\/title>\n<meta name=\"description\" content=\"Exceptional housing measures COVID19.
