{"id":2194,"date":"2020-04-23T10:00:33","date_gmt":"2020-04-23T08:00:33","guid":{"rendered":"https:\/\/www.alting.com\/measures-leases-premises-covid19\/"},"modified":"2026-01-23T14:52:27","modified_gmt":"2026-01-23T13:52:27","slug":"measures-leases-premises-covid19","status":"publish","type":"post","link":"https:\/\/www.alting.com\/en\/measures-leases-premises-covid19\/","title":{"rendered":"New measures affecting leases on premises due to Covid-19"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>WHAT REQUIREMENTS DO SMEs AND SELF-EMPLOYED WORKERS HAVE TO MEET TO REQUEST THEM?<\/strong><\/p>\n<p>Today, Wednesday April 23 2020, <a href=\"https:\/\/www.boe.es\/diario_boe\/txt.php?id=BOE-A-2020-4554\">Royal Decree Law 15\/2020, of 21 April<\/a> went into force, which among other extraordinary measures to counteract the effects of Covid-19, <strong>established measures regarding non-residential leases for SMEs and self-employed workers<\/strong> whose <strong>activity has been affected by the Government\u2019s measures<\/strong>.<\/p>\n<h3>What does the new Royal Decree Law say on renting premises?<\/h3>\n<p>This new Royal Decree Law <strong>makes it obligatory for lessors considered \u2018large holders\u2019 to grant tenants a full moratorium (deferment) on all rent due<\/strong> for the duration of the state of emergency and, if this is not sufficient, also on the following monthly payments, <strong>extendible on a month-to-month basis, for up to four monthly payments<\/strong>.<\/p>\n<p>As with the rest of the exceptional measures created during the state of emergency, <strong>under no circumstances may leases be terminated<\/strong>, so they remain fully in force and applicable in all their effects, including payment of rent due. Therefore,<strong> tenants may not unilaterally refuse to comply with the lease agreement<\/strong>, or the extraordinary measures that may apply, and if they do,<strong> the lessor may demand compliance or termination of the lease.<\/strong><\/p>\n<h3>What is a Large Holder, for the purposes of this RDL?<\/h3>\n<p>Large Holders are <strong>individuals or legal entities<\/strong> with <strong>more than 10 urban properties<\/strong> (excluding garages or storage spaces), or fewer properties with a combined <strong>total floor space<\/strong> of <strong>more than 1,500 m\u00b2.<\/strong><\/p>\n<h3>Who can request rent deferral?<\/h3>\n<p>It is important to understand that, for this obligatory deferment to apply, the tenant must:<\/p>\n<ol>\n<li>Request it before 23 May 2020.<\/li>\n<li>Have their economic activity affected by the space leased and<\/li>\n<li>Provide proof of:<\/li>\n<\/ol>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li>Their status as an SME or self-employed worker whose activity has been suspended as a result of the Government\u2019s measures.<\/li>\n<li>And that their turnover has dropped by 75%. This requirement must be verified in an affidavit from the interested party and the lessor may ask to see the accounts to confirm it.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>These measures do not apply in cases when the lessor and tenant reached an agreement prior to the application of RDL 15\/2020, meaning before 04\/23\/2020.<\/p>\n<h3>What happens when the owner is a small holder?<\/h3>\n<p><strong>If the owner has 10 or fewer properties<\/strong>, the tenant can also request deferral of rent payments, under the same conditions as the Large Holders. In this case, however,<strong> the measure isn\u2019t obligatory<\/strong> and the lessor may deny the request.<\/p>\n<p>If <strong>the parties reach an agreement<\/strong>, the lessor may perceive part or all of the rent deferred through the guarantees (<strong>legal deposit and additional guarantees<\/strong>) established in Article 36 of the LAU (Spanish Urban Lease Act) provided by the tenant upon signing the lease agreement.
